These Terms & Conditions explain the rules that apply when you request, book, purchase or participate in an experience offered by Essaouira Portrait.
Acceptance of These Terms
By submitting a booking request, paying a deposit or balance, or participating in one of our experiences, you confirm that you have read, understood and agreed to these Terms & Conditions.
These terms apply to horse riding holidays, horse photoshoots, riding sessions, private experiences and any related service offered by Essaouira Portrait.
Bookings & Confirmation
All booking requests are subject to availability. Sending a request through our website, WhatsApp, email or social media does not automatically confirm a reservation.
A booking is confirmed only after Essaouira Portrait has approved the requested date, experience, participant information and any required payment, and has sent written confirmation to the client.
Clients are responsible for checking the confirmation details and informing us promptly of any mistake.
Prices, Guests & Payments
Unless clearly stated otherwise, prices shown on our website or booking materials are quoted in euros (€) and are per person.
- A couple photoshoot is charged for two participants.
- A sunrise photoshoot carries an additional €50 supplement.
- A flying dress option carries an additional €50 supplement.
- A second galloping horse option carries an additional €50 supplement.
- Any other optional extra will be shown or confirmed before payment.
Payment instructions, deposit requirements and balance due dates will be provided during the booking process. A reservation may be released if payment is not received by the stated deadline.
Accurate Participant Information
Clients must provide truthful and complete information about each participant, including riding level, experience, confidence, relevant physical limitations and any matter that may affect safe participation.
We use this information to select suitable horses, positions, routes and activities. Failure to disclose relevant information may result in an activity being changed, limited or refused for safety reasons.
Safety & Horse Welfare
Horse riding is an outdoor activity involving animals and natural terrain. It carries inherent risks that cannot be completely removed.
Participants must follow all instructions given by Essaouira Portrait staff, guides and horse handlers. We may change or refuse a pose, speed, route, horse or activity whenever we believe it is necessary for the safety of the participant, staff, other guests or horses.
Horse welfare always comes first. No requested photograph, video, pose or riding activity is guaranteed if conditions are unsuitable or if it would place unnecessary pressure on a horse.
Weather, Conditions & Itinerary Changes
Outdoor experiences may be affected by wind, rain, heat, tides, beach conditions, visibility, horse welfare considerations or other circumstances beyond our reasonable control.
We may adjust the start time, location, route, schedule, horse allocation, sequence of activities or included elements when reasonably necessary. Sunrise and sunset lighting cannot be guaranteed.
Drone filming, horse swimming, galloping and certain advanced poses are always subject to weather, location, safety, rider ability and local conditions.
Cancellations, Changes & No-Shows
Cancellations, date changes, refunds, credits and no-shows are governed by our separate Cancellation Policy, which forms part of these Terms & Conditions.
Clients should read the Cancellation Policy before confirming a booking. Where a booking includes accommodation, transfers, meals, external suppliers or other reserved services, additional supplier conditions may also apply.
Photography, Video & Image Use
For photoshoot experiences, the final selection, editing style and delivery of successful images and video clips are determined by Essaouira Portrait’s professional judgment.
Raw or unedited files are not included unless expressly agreed in writing. Delivery timeframes are estimates and may vary according to workload, season and the size of the project.
We will not use identifiable client images for advertising or public promotion without the client’s permission, except where the client has separately provided consent.
Personal Belongings & Client Responsibility
Participants are responsible for their personal belongings, clothing, phones, cameras, jewellery and other valuables during an experience.
Clients must arrive on time, wear suitable clothing and footwear, and avoid behaviour that could place themselves, another person or a horse at risk.
Participants must not take part while impaired by alcohol, drugs or medication that makes participation unsafe.
Accommodation & Third-Party Services
Some experiences may include or recommend accommodation, restaurants, transport providers, guides or other independent suppliers.
Those services may be subject to the supplier’s own terms, availability and operational decisions. We will use reasonable care when selecting suppliers, but we do not control every aspect of an independently operated service.
Respectful Conduct
We reserve the right to refuse or end participation where a guest behaves abusively, ignores safety instructions, mistreats an animal, damages property or disrupts the experience of other guests.
In such circumstances, the guest may not be entitled to a refund for the unused part of the service.
Participants Under 18
A participant under 18 must have permission from a parent or legal guardian. Depending on the experience, age and riding level, we may require the parent or legal guardian to be present or to complete additional consent documentation.
Liability
Nothing in these terms excludes or limits any responsibility that cannot legally be excluded.
To the extent permitted by applicable law, Essaouira Portrait is not responsible for indirect losses, loss of enjoyment caused by circumstances outside our reasonable control, or loss resulting from a participant’s failure to follow instructions or provide accurate information.
Clients are strongly encouraged to arrange appropriate travel and activity insurance covering cancellation, medical treatment, personal accident, baggage and horse riding activities.
Governing Law & Changes to These Terms
These Terms & Conditions are governed by the applicable laws of Morocco. Any dispute should first be raised directly with Essaouira Portrait so that both parties can attempt to resolve it fairly and promptly.
We may update these terms when our services, booking practices or legal obligations change. The version displayed on this page at the time of booking will normally apply to that reservation.
